Sounds like the Council wants everything to stay the same. The citizens can initiate a Charter change with a petition. Maybe the community needs to show them just how many folks want 7 council members and Districts.

Best use of Main St. lot debated

Bastrop, Tx–After a public hearing Tuesday the city council seems no closer to deciding what to do with a vacant lot it owns fronting 921 Main St. downtown.

As expected, the council heard competing visions of the best future use of the property which the city bought last year. The entire property extends from Main to Water Street, and the city has long planned to use most of the site for parking improvements. The 110 feet closest to Main is too narrow to use for parking, according to City Manager Mike Talbot.

The site was formerly home to the Texas Mercantile craft and antique outlet. That building burned in 2003 and was never rebuilt.

Speaking on behalf of the Bastrop Main Street Advisory Board, Steve DeWire laid out a vision for a downtown plaza and visitor comfort station on the site, including rest rooms, landscaping and shade trees. Such a public space would attract visitors to stay longer in the area and boost downtown sales, he argued.

He estimated the initial cost at $259,000 plus some $4,400 annual maintenance expense, chiefly rest room upkeep.

The Bastrop Economic Development Corp. offered a different vision. The board is ready to work with the council to redevelop the space for commercial use, returning the property to the tax roll and generating salex tax income, said BEDC President Joe Newman.

For instance BEDC could buy the site from the city for market value and then negotiate with potential developers with far more flexibility than state law permits the city to offer, said Newman.

More than one potential developer is awaiting a city decision, he said.

At the end of public testimony, Council Member Joe Beal said he still has little evidence about the likely economic impact of either choice.

Mayor Terry Orr noted that grant funding could help pay for a public use project, and the site “looks like a festival space to me.”

Citizen meeting on transparent government in San Marcos

The public is cordially invited to a “Transparency in Local Government” open meeting on Monday, August 16 at 7pm at the San Marcos Public Library.

We will start the meeting with a brief presentation on transparency and open local government, including examples of what other communities across the US are doing. Then we will do an open forum where we will get more public input and your ideas for open local government, followed by a list reduction exercise to help prioritize the top ideas.

We want to create a “Top Ten” list of initiatives that are actionable, timely, meaningful, and cost effective. This “Top Ten” list will facilitate focus and dialog with local candidates and current elected leaders and city staff.

This is the start of an on-going journey. Towards the end of the meeting, we will discuss next steps. Plenty of community members want to see more transparency and open government. There has been enough interest to form a new group dedicated to championing this cause. The current name for this group is “Open San Marcos,” but we can brainstorm other names and finalize the on-going group name at this meeting.

Please mark your calendar and plan to attend. And, spread the word, let others know about it. It is an open public meeting. And, feel free to contact me if you have any suggestions in the meantime.

San Marcos Mayor Susan Narvaiz announced today that she will not seek a fourth term as mayor in November.

“After months of thought and prayer, I have decided not to seek another term as Mayor of San Marcos. I am incredibly grateful for the support of our community, the dedication of City staff, the hard work by the City Council and the great achievements of the past eight and a half years of my service to the City. This has been an awesome journey! A journey made possible by each and every one of you who have supported me during my years of service. I want to thank my family and friends who have continued to encourage me, but most especially my husband, Mike, with whom God has blessed me.

During my tenure, I have devoted my best ideas, my most creative thinking and my passion to bring greater prosperity to our community. I have been humbled and amazed at the spirit of the people who call San Marcos home for their families, their businesses and for education.

The list of accomplishments of the City Council in the past eight years is long and varied. It includes once-in-a-lifetime opportunities such as the transformation of Rio Vista Dam, the acquisition of the 251 acre Springlake Preserve, and the construction of the first two railroad overpasses in our city’s 159 year history on Wonder World Drive and Yarrington Road.

We have created unique and successful partnerships, such as the five year process to negotiate and construct the Embassy Suites Hotel and City of San Marcos Conference Center and the expansion of the outlet malls. Our hotel and conference center have become a premier attraction for conferences and special events large and small along the I35 corridor. We have expanded both malls and encouraged other retail developments to ensure our competitive edge in the retail market, protecting our important sales tax revenue. During this time we revitalized the cornerstone buildings in our Downtown to renew our commitment to the core of our city. We made significant improvements in our development processes to demonstrate San Marcos is open for business.

We have completed such exciting transportation and public safety projects as the Wonder World Drive extension, Post Road, Sessom Drive, our Airport Tower, and the new Fire Department headquarters. We have initiated other voter approved bond projects such as McCarty Lane/ Loop 110, Rio Vista Terrace, and Victory Gardens to improve the infrastructure, quality and mobility of our neighborhoods.

We have implemented many significant financial policies at City Hall that protect our local government from downturns in the economy and provide a strategy to manage spending reductions when necessary. We also adopted a formal, responsible economic development plan with guidelines for incentive consideration based on job creation with increased salary structures and performance accountabilitites.

In recent years, we have created thousands of new jobs, according to CAPCOG. CNNMoney.com has designated Hays County as the third top job-creating county in the United States—much of that attributed to job growth in San Marcos. San Marcos was named by BusinessWeek Magazine as one of the top 10 places to raise children. San Marcos was added back into the “Austin-Round Rock-SAN MARCOS” Metropolitan Statistical Area—demonstrating that our community is an important and influential anchor city in the region.

We have strived for openness and citizen involvement on so many levels: initiating the annual Citizen Summit to gain input for our goal setting and our budget process. We revised the City Council meeting agendas to offer multiple opportunities for citizen comment during meetings and public hearings. We implemented the annual State of the City address to report back on our progress and the challenges San Marcos faces. We initiated regular coffees at City Hall, neighborhood walks, and award-winning programs such as the ACT (Achieving Community Together) program to bridge the divide between student and non-student residents of our community. We established processes to engage more citizens in Board and Commission service and initiated Appreciation events like our Veteran’s Day Parade acknowledge our heroes and thank our volunteers. We added a Texas State student liaison at the dais with the City Council—to ensure that the perspective of university students is heard and to expand their understanding of their personal responsibilities as community members.

We have emphasized partnerships at many levels—starting with citizens, neighborhoods, Texas State University, Hays County, the region, the State of Texas and the U.S. Congress.
I am grateful for the opportunity to have served the citizens of San Marcos as Mayor and thankful for the many people that I have had the great privilege of working with who were integral to the success that we have all shared in.

I look forward to the future with great faith in the commitment of our City staff and community leaders to build upon our achievements. I know that I stood on the broad shoulders of those who came before me, and I am proud to have been able to provide a foundation for those who will come after. I thank all of you who welcomed me to city hall years ago, an average citizen who happened to become your mayor, and I go forward with confidence that the best is yet to come! May God continue to Bless San Marcos.”

Bastrop council hammers out city charter change proposals

Bastrop, Tx–Tuesday the Bastrop City Council hammered out details of changes to the city charter which will go before voters in a November election, chiefly making council terms three years long instead of the current two.

The change was recommended earlier this year by a charter review committee headed by Council Member Ken Kesselus. The study panel was named by the mayor and other council members.

The council, however, declined to ask voters to consider adding two additional members to the city governing board, saying there appears to be little public support for such a measure now.

As currently proposed, the charter change would limit the mayor and council members to two consecutive three-year terms. Those officers would be forced to wait a year before seeking re-election.

The Texas Constitution will force additional changes in current city election rules if voters endorse three-year council terms, said city attorney J.C. Brown. The chief change will require that council members and the mayor be elected by majority vote instead of the plurality currently required. That could force run-off elections in some cases, said Brown.

In a related measure the council agreed to ask voters to decide if a sitting council member should be required to resign in order to run for the mayor’s seat. At the same time a mayor would be required to step aside in order to seek a council seat.

Other charter changes to go before voters include changing the title of the presiding officers of the Planning and Zoning commission from “chairman” and “vice chairman” to “chair” and “vice chair.” The mayor would also become the city’s “chief presiding officer” instead of the city’s “chief executive officer.”

Buc-ee’s seeks Bastrop tax rebate

Bastrop, Tx–Buc-ee’s, the convenience and travel center retail chain, wants to build a 45,000-square-foot store in Bastrop, but needs a 10-year sales tax break to do so, the city council heard Tuesday.

Buc-ee’s founder Beaver Aplin offered two arguments to justify the rebate request. First, he said, his bank needs the assurance of sales tax rebates as security for the construction loan, estimated at $6.8 million for the store at Texas 95 and Texas 71. Aplin also argued that some street and utility work required by city rules will provide benefits to adjoining property owners as well as his project.

Aplin asked for the city’s 1.5 percent sales tax on store sales to be reimbursed to Bec-ee’s for 10 years. That represents the share of the state’s 8.25 percent salex tax which currently goes to the city and the Bastrop Economic Development Corp. He is not seeking relief from local property and other taxes.

The rebate, if approved, could amount to some $150,000 a year. Aplin said his proposed store will not really compete with other local convenience stores because it’s a different class of operation.

Council Member Joe Beal asked for a formal written abatement proposal from Aplin before the council considers the request further.

Council Member Julie Hart said she encourages local retail competition as long as “it’s on a level playing fied,” suggesting that a sales tax rebate for Buc-ee’s might tilt the advantage.

Re-hired San Marcos police officer forbidden from doing police work, DA says

UPDATE 6:30 P.M. This entry has been revised to reflect that the arbitrator ruled that the charges of dishonesty and excessive force against Officer Stephens were not substantiated, not that the punishment of termination was too harsh.

A San Marcos Police Department terminated for not being truthful on two occasions and a use-of-force violation remains back on the force, but is effectively unable to perform police duties after a decision by Hays County District Attorney Sherri Tibbe.

Officer Paul Stephens was indefinitely suspended last October over an incident where he used a baton against a woman who was not resisting and was not a physical threat, and for later making a false statement about the encounter in his report. However, an independent arbitrator ruled in June that the charges of charges of dishonesty and excessive force could not be substantiated, and Police Chief Howard Williams was bound by law to re-instate him.

But a June memo from Tibbe to Williams says that due to Stephens’ “history for dishonesty,” her office will be unable to call Stephens as a witness in any case and cannot prosecute any case in which he is an investigating officer. Stephens’ credibility problems could endanger cases when they go to trial, Tibbe argued, because her office is bound to disclose his history to defense attorneys.

Williams, who said today that he agrees with Tibbe’s decision, said that this means Stephens will remain on the force but can’t enforce the law or make arrests.

“She can’t put him on the stand,” Williams said. “A defense attorney would tear him up.”

Stephens was also involved in an August traffic stop that garnered national attention.

In that case, Stephens stopped Michael Gonzales on Interstate 35 for driving 95 mph, 30 miles above the speed limit, as he swerved through traffic. Gonzales and his girlfriend were taking their dog, which was choking on food, to a veterinarian in New Braunfels.

The couple said the dog died during the approximately 20-minute stop. Footage from patrol car cameras shows that Stephens chastised Gonzales for speeding, telling the distraught man that it was just a dog and that he could get another one.

BEDC firms up spending proposals for FY 11 budget year

Bastrop, Tx–Monday the Bastrop Economic Development Corp. board set some major spending goals to put before the Bastrop City Council later this year. The projects include more than $2 million to extend roads and add some 20 new lots in the board’s Industrial and Business Park.

Also on the to-do list is some $320,000 to replace existing street lights on Main Street between Farm Street and the 800 block of Main. That suggestion, from City Manager Mike Talbot, was greeted with enthusiasm by the board which has long contemplated such a project but expected the price to be much higher, possibly more than $1 million.

The board agreed to decide later how to finance the projects, either with new borrowing, cash reserves or current operating funds. That decision can be postponed, the board decided.

Any BEDC spending plan for the coming fiscal year must also be approved by the Bastrop City Council sometime in the next two months.

Last year the BEDC board also proposed expanding the industrial park, but the city council finally approved only funds for final engineering for the project.

The Main Street lighting effort would replace current street lights with antique-style lighting along the three-block section of the historic commercial district, said Talbot. As presently envisioned, the work also includes replacing underground electric lines in order to support additional holiday lighting displays which have long been sought by downtown merchants.

Kyle mayor to host town hall meeting on budget

From Mayor Lucy Johnson:

The Mayor will be hosting “Budget Talk,” a Town Hall Meeting, Wednesday, August 4th from 7 p.m. to 9 p.m., at the Kyle City Hall to discuss and share ideas with Kyle residents concerning the Fiscal Year 2010-2011 Budget. The purpose of this meeting is to involve the public in our city’s budget process. The Mayor urges anyone wishing to voice their concerns over property taxes, city debt and the availability of city services to attend and participate.

“Since my first meeting as Mayor on March 3rd, council chambers have been filled with residents eager to get involved and have their voices heard. I am eager to encourage this process to continue, and I look forward to hearing the public’s concerns about our upcoming budget.”

August marks the end of Mayor Johnson’s first six months in office. During this short period, Ms. Johnson has presided over the departure of former city manager Tom Mattis, the election of two new council members, and the re-opening of the Kyle Historic City Hall.

Since March, the new City Council has also written its first ever Budget Policy Statement, created three new committees (Small Business Committee, City Manager Search Committee, and the Charter Review Commission), successfully negotiated a 3-year Meet and Confer Agreement with the Kyle Police Association, approved a construction agreement for the new Kyle Library, passed an ordinance allowing temporary and mobile food vendors, completed work on the city’s Comprehensive Plan, established a new 5-year Capital Improvement Plan, and joined two regional planning organizations (Partners For Progress and Envision Central Texas).

For residents interested in reviewing the proposed Fiscal Year 2010-2011 Budget, the entire budget will be available shortly on the city website: www.cityofkyle.com.

Former San Marcos council member Daniel Guerrero announces run for mayor

Daniel Guerrero, who served on the San Marcos City Council for four years, has announced that he’s running for mayor.

Guerrero, 33, was on the council from May 2004 to November 2008. He is currently the executive director of the San Marcos Education Foundation, which provides grants and scholarships for higher education and recognizes local educators. He’s also a graduate of San Marcos High School and Texas State, where he received a bachelor’s degree in mass communications with an emphasis in public relations.

So far, Guerrero will run against current Council Member John Thomaides and Daniel McCarthy, who ran for mayor and lost in 2008. Incumbent Mayor Susan Narvaiz has yet to announce whether or not she’ll run again.
